1. Acceptance of Terms

By accessing or using AI-RADAR at radar.cubinkdigital.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service. These terms constitute a legally binding agreement between you and Cubink Digital (operated by Jerome Vaultier).

2. Description of Service

AI-RADAR is an automated business diagnostic tool that analyses publicly available information about your business website and generates a report covering AI visibility, business coherence, and revenue infrastructure gaps. The service includes:

• A qualification assessment (9 questions)
• An AI-generated diagnostic report delivered via email link
• Access to a private report URL for a limited period
• Optional follow-up consultation (Simulator session, subject to availability)

3. Eligibility & Acceptable Use

You must be at least 18 years old and represent a legitimate business to use AI-RADAR. You agree not to:

• Submit false, misleading, or fraudulent information
• Submit URLs belonging to businesses you do not own or represent
• Use the service to reverse-engineer our methodology or AI prompts
• Attempt to generate multiple reports for the same business using different accounts
• Use automated tools, bots, or scripts to interact with the service
• Resell, redistribute, or commercially exploit report content without written permission

Cubink Digital reserves the right to decline, restrict, or terminate access to any user at any time for any reason.

4. No Guarantee of Results

AI-RADAR provides diagnostic information based on publicly available data and AI analysis. Reports are informational only and do not constitute professional business, legal, financial, or marketing advice. We make no guarantees regarding:

• The accuracy or completeness of AI-generated assessments
• Business outcomes resulting from implementing report recommendations
• The current state of AI platform coverage for any business
• Revenue improvements or competitive outcomes

Always seek qualified professional advice before making significant business decisions.

5. Intellectual Property

The AI-RADAR methodology, scoring framework, report design, and all associated technology are the intellectual property of Cubink Digital. Your report is generated for your personal business use only. You may not:

• Share, publish, or distribute report content without attribution
• Use report content in competitor products or services
• Claim the methodology or framework as your own

You retain ownership of any business information you submit. By submitting, you grant Cubink Digital a limited licence to process that information for report generation purposes.

6. Limitation of Liability

To the maximum extent permitted by law, Cubink Digital shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of AI-RADAR, including but not limited to loss of revenue, loss of data, or business interruption. Our total liability in any circumstance shall not exceed €100.

7. Service Availability

We reserve the right to modify, suspend, or discontinue AI-RADAR at any time without notice. We may limit the number of reports generated per user, per domain, or per time period. Access to the Simulator session is subject to availability and is not guaranteed.

8. Governing Law

These terms are governed by the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of France. If you are a consumer in the EU, you may also have rights under applicable consumer protection laws in your country of residence.

9. Changes to Terms

We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the updated terms. Significant changes will be communicated via email where possible.
